TRADING
TERMS AND CONDITIONS
PAYMENT:
With
order (Bankcard, Visa or Mastercard accepted) title to all goods sold and
delivered to the customer
shall remain the property of the supplier (Designer
Folders Pty.Ltd.) until such time as the monies due, from the customer to the
supplier, are
paid in full. Should any payment be in default the
customer
acknowledges that he/she will be responsible for
all costs incurred in recovery of any amount unpaid
by the due date and further will pay all commissions, professional fees whether
solicitors, client, party
to
party, agents, on any recoveries necessarily incurred
in recovery of any amounts in default and further acknowledges that all costs
will be treated as a liquidated debt and agrees to be bound by these conditions.
Accounts may be applied for: Conditions
for an account (OUR CREDIT POLICY) are outlined below.
A) Accounts
are due for payment on the 15th day of the month
following the month the goods were
invoiced.
A statement will be
issued at the end of each month summarising your purchases.
B)
Credit will lapse on overdue accounts and “Cash with Order” will
apply.
C)
Customer’s dishonoured cheques marked with (“Present Again”,
“Refer To Drawer” or “Stop Payment”)
will incur a $20.00 financial
charge each time,
to compensate for Bank Charges and administrative costs. Your Credit facility
will be
terminated after
we receive two (2) “dishonoured
cheque”
notices and “Cash with Order” or
“COD” will
apply.
D) Minimum
monthly trading must average $300.00.
RETURNS:
No
returns without prior permission. A
20% restocking and handling fee will be applied to
merchandise
returned in a “Saleable” condition. Definitely
no returns accepted after the month in which they were invoiced. No credits
raised for goods sent in error until goods returned.
CLAIMS:
All
claims for errors or shortages in orders supplied by Designer Folders to any
customer, must be made within (7) days “from date of invoice”.
DELIVERY:
All
care is taken in packing your order, but no responsibility can be assumed for
goods damaged
or lost in transit. We evaluate all orders to ensure
that they are sent the most economical and efficient way. Freight charges are
payable by the customer. If D.F. incurs any additional surcharges from the
freight companies, due to non delivery of a customer’s
parcel the first time (hence several attempts
have been
made)
these will be passed on to the customer.
DISCLAIMER:
Designer
Folders reserves the right to display and use for the purposes of promoting
any folders or products that we have printed with any customer’s
logo or name. Designer Folders bears no responsibility or liability for any
claims or legal action arising from any action taken as a result of Designer
Folders displaying any photograph/s given to us
by any person/s or customer of Designer Folders Pty.
Ltd
for
the purpose of promoting any of Designer Folders products.
Any ideas or products designed by special request
for clients will be deemed to be the intellectual property
of D.F.
GUARANTEE:
Designer
Folders
will
replace any product if
it
is deemed defective
in materials or workmanship, by
the manufacturer, however,
this does not apply to damage caused by normal wear, misuse or accidental
damage. Designer
Folders
shall not be liable for damages to
materials placed into, affixed or stored
within its
products or other incidental or consequential damage. Likewise if any of our
products are used in such a manner, other
than what they
were intended for, or modified in any way using other products to complete them,
we will not be liable for any damage to our products.
